These Terms and Conditions govern your use of the OpsMaster platform and the Ai-Link app (the "Service") provided by Saada & More for Projects Co. (the "Company" or "we"). By using the Service, or by agreeing when asked, you confirm that you have read these Terms and agree to be bound by them.
1. Scope of the Service
The Service is a cloud operations platform (attendance, leave, contracts, invoices, tickets, custody, assets, visitors and more) made available to subscribing organisations, their employees and customers through the website and the mobile app. The features available to you are determined by your organisation and your account permissions.
2. Account and Security
- Accounts are created by, or by invitation from, the organisation you belong to, and you are responsible for keeping your login details confidential.
- Do not share your password with anyone, and report any unauthorised use of your account immediately.
- You are responsible for activity carried out through your account unless you have reported it as compromised.
3. Acceptable Use
- Use the Service only for lawful professional purposes connected to your work or your relationship with the organisation.
- You must not attempt to access data not assigned to you, disrupt the Service, bypass security or permission controls, or introduce malicious software.
- You must not submit content that is unlawful or infringes the rights of others, or use the Service to send spam.
- You must not provide misleading information or impersonate another person, including recording attendance on someone else's behalf.
4. Data and Ownership
- Data entered into the Service by the organisation, its employees and customers (work records, contracts, invoices and so on) belongs to the subscribing organisation; the Company acts as a service provider processing it on the organisation's instructions.
- The organisation and you grant us a limited licence to store and process the data as needed to operate, support and improve the Service.
- We do not sell your data. What we collect and how we use it is described in the Privacy Policy.
5. Privacy
The processing of your personal data is governed by the Privacy Policy, which forms an integral part of these Terms. Your agreement to these Terms does not replace reading the Policy.
6. Availability
We aim to keep the Service available continuously but do not guarantee uninterrupted or error-free operation. The Service may be suspended temporarily for maintenance, updates or reasons beyond our control (internet outages, third-party providers and others). We try to notify organisations of scheduled maintenance where possible.
7. Intellectual Property
The Service, its software, design and trademarks are owned by or licensed to the Company. Using the Service gives you no ownership rights in it; your right is limited to using it under these Terms. Copying, reverse engineering or reselling it is prohibited.
8. Limitation of Liability
- The Service is provided "as is" and "as available".
- To the extent permitted by law, the Company is not liable for indirect or consequential loss or loss of profit arising from use of, or inability to use, the Service.
- Our total liability to the organisation shall not exceed the subscription fees paid for the twelve months preceding the event, to the extent this does not conflict with mandatory law.
- Nothing here excludes liability that cannot be excluded by law.
9. Suspension and Termination
- The organisation or the Company may suspend or terminate your account if these Terms are breached, your relationship with the organisation ends, or its subscription ends.
- You may stop using the Service at any time and request deletion of your data through the Data Deletion Request page.
- Provisions that by nature continue (intellectual property, limitation of liability, governing law) survive termination.
10. Changes to These Terms
We may update these Terms from time to time. For any material change we will show you the updated version with a summary of what changed and ask for your agreement before you continue using the Service. The version number and effective date always appear at the top of the page.
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, and the competent courts in the Kingdom shall have jurisdiction over any dispute arising from them, after first seeking an amicable resolution.
